This is a notice, not an argument. The argument comes later.
On October 9, 2026, a new Replit Pro Agreement replaced the old one for existing Pro customers. It adds mandatory arbitration and a class-action waiver. The old agreement had neither.
The new agreement's own words: "To opt out, Customer must notify Replit within thirty (30) days after first becoming subject to this arbitration agreement." Replit, in writing on October 28: "The new Pro Agreement took effect for existing Pro customers on October 9, 2026." Thirty days from October 9 is November 8. If you signed up for Pro after the new agreement was posted in September, it applied when you registered, so your thirty days started then and may already have run.
The September email announcing the change gave this one clause: "You can opt out within 30 days as described in the Pro Agreement." It didn't give the date or the address.
Email arbitration-opt-out@repl.it from the email on your Replit account. The agreement says the notice must include:
your full name
your mailing address
your Replit username
the email address on your account
a clear statement that you opt out of the Arbitration Agreement in Section J of the Pro Agreement
Keep a copy. Each person sends their own: the agreement says "No individual may opt out on behalf of another party," so on a team, everyone opts out for themselves. (What opting out does: it keeps your right to take a dispute to court instead of a private arbitrator. It doesn't decide any claim.)
A template you can paste:
Subject: Opt-out of Arbitration Agreement (Pro Agreement, Section J)
I opt out of the Arbitration Agreement in Section J of the Replit Pro Agreement.
Full name:
Mailing address:
Replit username:
Account email:
Open Settings, then Personalization, scroll to the bottom and expand the last section. There's a setting called Model Improvement. On September 9 it was turned on by default for what Replit calls "eligible" Pro accounts. If it's on and you want it off, turn it off. It's per person, so check every seat on your team. Replit says turning it off applies to new content only; the opt-out "isn't retroactive."
Thirty seconds: the form. Anonymous is fine. If you add your Replit username, you count in the verified tally. We'll publish the totals, never the names.
That's the notice. Keep your receipt.
